                                ORDINANCE NO. 9491
        
        
                   AN ORDINANCE TO AMEND THE ORDINANCE NO. 9456,
                   ENCAPTIONED AS SET FORTH HEREIN, SO AS TO ADD
                   CERTAIN CONDITIONS TO A REZONING OF PROPERTY
                   LOCATED IN THE 2400 AND 2500 BLOCKS OF COWART
                   STREET.

              	   WHEREAS, on October 4, 1990, the City Council of the
         City of Chattanooga, Tennessee, enacted Ordinance No. 9456
         encaptioned, "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
         AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE THREE
         TRACTS OF LAND LOCATED IN THE 2400 AND 2500 BLOCKS OF COWART
         STREET, BEING ON THE NORTHWEST AND SOUTHEAST LINES OF COWART
         STREET AT WEST 25TH STREET FROM R-3 RESIDENTIAL ZONE TO C-2
         CONVENIENCE COMMERCIAL DISTRICT."; and
              	   WHEREAS, said Ordinance inadvertently omitted a
         condition upon said rezoning;
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 9456, encaptioned as 

         set forth above, be and the same is hereby amended by adding 
the
         following condition:
                   "The properties fronting on the west side of
                   Cowart Street shall be screened by a 6 foot
                   wooden sight-obscuring fence to be located
                   along the east property line and extending
                   from West 25th Street to West 26th Street
                   except for one opening which shall serve as
                   secondary access to the site from Cowart
                   Street."
                  
         	   BE IT FURTHER ORDAINED, that this Ordinance shall take
         effect two weeks from and after its passage, the public welfare 

         requiring it, provided, however, that this Ordinance shall be
         operative immediately upon passage on third and final reading.
